Terms of Service

1. Introduction

These terms of service ("Terms") govern your use of PicReel ("the Service"), operated by Mitchell Cloud Solutions LTD ("we", "us", or "our"), a company registered in England and Wales.

By using PicReel, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

PicReel allows you to create and share photo slideshows. You can upload photos, arrange them into a slideshow, and share a link with others to view.

We offer the following tiers:

• Free: Up to 50 photos, available for 7 days, includes "Made with PicReel" watermark.
• Premium (£4.99): Up to 300 photos, available for 1 year, no watermark.

3. Account Registration

To use PicReel, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activities that occur under your account.

You must be at least 16 years old to use this Service.

4. Your Content

You retain ownership of all photos and content you upload to PicReel ("Your Content"). By uploading content, you grant us a limited licence to store, process, and display Your Content solely for the purpose of providing the Service.

You agree that Your Content will not:

• Violate any laws or regulations
• Infringe any third party's intellectual property or privacy rights
• Contain illegal, harmful, threatening, abusive, or hateful material
• Contain sexually explicit material involving minors
• Promote violence or discrimination

We reserve the right to remove any content that violates these Terms without notice.

5. Payments and Refunds

Premium upgrades are one-time payments processed securely by Stripe. All prices are in British Pounds (GBP) and include VAT where applicable.

Due to the digital nature of the Service, refunds are generally not available once a Premium upgrade has been activated. However, if you experience technical issues that prevent you from using the Service, please contact us and we will assess your case.

Under the Consumer Contracts Regulations 2013, you have a 14-day cooling-off period for digital purchases. However, by using the Service immediately after purchase, you acknowledge that you lose this right of withdrawal.

6. Data Retention and Deletion

Free tier slideshows are automatically deleted after 7 days. Premium slideshows are retained for 1 year from the date of purchase. After these periods, your photos and slideshow data will be permanently deleted.

You may delete your slideshow at any time from your dashboard. Deleted content cannot be recovered.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt the Service
• Upload malware, viruses, or malicious code
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorisation

8. Intellectual Property

The software, website design, and original content (excluding Your Content) are owned by Mitchell Cloud Solutions LTD and are protected by copyright laws.

You may not copy, modify, distribute, or create derivative works based on our software without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Mitchell Cloud Solutions LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities.

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend or discontinue the Service at any time for maintenance, updates, or other reasons.

We will endeavour to provide reasonable notice of any planned downtime or discontinuation of the Service.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service will cease immediately, and your data may be deleted.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
